Judicial officer. What steps should we take in the event of an enforcement action against us.
When we receive a PDI / invitation for voluntary execution, /a PPI / subpoena for enforcement or a notice from a judicial officer, we recommend that you immediately contact a lawyer to assess how the enforcement action was initiated and the issuance of a writ of execution. It is possible that this has happened on the basis of a warrant proceeding which has developed, either with a preliminary immediate execution or under Article 410 of the Code of Civil Procedure, and you have not found out about it due to bad faith actions against you or on the basis of an enforcement order issued in an action proceeding. In my practice there are very often cases in which you could have taken actions that would have brought a positive result, but for various reasons the debtor has delayed, has not sought competent help, has been misled by the "advice" of the judicial officer that nothing can be done and so these opportunities are irretrievably lost. Enforcement proceedings are multifaceted and to use even the few opportunities to react requires years of experience, which we have at the firm. You could save yourself a lot of trouble with a consultation , because the problem should be examined carefully, thoroughly and quickly , and neglecting it does not lead to anything positive.
